Terms of Use

These Terms of Use (“Terms”) govern your access to and use of NurseExhale, operated by Wiser5 LLC (“Company,” “we,” “us,” or “our”), including the mobile application and the marketing site at wiser5.com/nurseexhale (collectively, the “Service”). By downloading, installing, or using NurseExhale, you agree to these Terms. If you do not agree, do not use the Service. See also our Privacy Policy.

1. The Service

NurseExhale is a personal, shift-aware wellness companion for nurses and other healthcare professionals. It offers optional check-ins, short audio and guided tools, reminders, on-device community reading/writing, and related features designed to fit before, during, and after shift life.

NurseExhale is currently offered as a free product and may change, pause, add, or discontinue features at any time.

2. Not Medical, Mental Health, or Crisis Care

NurseExhale is a personal wellness tool. It is not a medical device, not therapy, not clinical decision support, and not a substitute for professional medical, psychiatric, or mental health care. Check-ins and scores reflect your own self-report; they are not diagnoses, treatment plans, or clinical labels.

If you are in crisis, thinking about harming yourself or others, or experiencing a medical emergency, contact local emergency services, a crisis line, or another appropriate professional resource immediately. Do not rely on NurseExhale for emergency support.

3. No Employer or Hospital Affiliation

NurseExhale is not provided by your employer, hospital, staffing agency, or licensing board. Use of the app does not create an employment, supervisory, or clinical relationship with Wiser5 LLC. Do not use NurseExhale to store protected health information about patients or to document clinical care.

4. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use NurseExhale. By using the Service, you represent that you meet this requirement and that you will use the Service in compliance with applicable law and workplace policies that apply to you.

5. No Account Required

Core features do not require creating a NurseExhale account. Preferences and wellness history are stored primarily on your device. You are responsible for activity on your device, for keeping the device reasonably secure, and for backing up or deleting local data as you choose.

6. Acceptable Use

You agree not to:

Use the Service for unlawful, harmful, fraudulent, or abusive purposes
Attempt to reverse engineer, scrape, overload, or disrupt the Service beyond normal personal use
Misrepresent your identity or affiliation when contacting support
Upload malware or attempt to interfere with other users’ devices or our systems
Use NurseExhale to collect, store, or transmit patient health information or other confidential workplace records
Treat NurseExhale content as professional medical, legal, HR, or safety advice

We may suspend or block access for abuse or risk to the Service or others.

7. Community Content

In the current version, community posts you create are stored on your device for your own reading experience and are not published to a Wiser5-hosted public network. You are responsible for the content you write. Do not include patient identifiers, employer confidential information, or other sensitive third-party data in posts.

If future versions introduce shared or moderated community features, additional rules may apply and will be described in updated Terms.

8. Intellectual Property

The NurseExhale name, branding, app design, audio sessions, written prompts, software, and related materials are owned by Wiser5 LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You may not copy, redistribute, publicly perform, or commercially exploit NurseExhale content or software without written permission, except as allowed by applicable law (for example limited personal device backups).

9. Feedback

If you send feedback, ideas, or suggestions, you grant Wiser5 LLC a worldwide, royalty-free license to use that feedback to operate and improve the Service. Do not submit confidential information you do not want us to use.

10. Privacy

Our Privacy Policy explains how we collect and use information, including on-device storage and product analytics. By using NurseExhale, you also agree to that Policy.

11. Third-Party Services and Stores

App Store and Google Play distribution, device notifications, and any third-party apps you open via share actions are governed by those parties’ terms. We do not control and are not responsible for third-party content, availability, or policies. Purchases or refunds through an app store, if any, are handled by that store’s rules.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR HEALTH OR WORKPLACE OUTCOME.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISER5 LLC AND ITS FOUNDERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF NURSEEXHALE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR NURSEEXHALE IN THE PRIOR TWELVE MONTHS (IF ANY), WHICHEVER IS GREATER.

14. Indemnity

You agree to indemnify and hold harmless Wiser5 LLC from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms.

15. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Updated Terms will be posted on this page with a new effective date. Continued use after changes constitutes acceptance. If you do not agree, stop using NurseExhale and uninstall the app.

16. Termination

You may stop using NurseExhale at any time by uninstalling the app. We may suspend or terminate access if you violate these Terms or if we discontinue the Service.

17. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction provide otherwise. Courts located in Florida shall have exclusive jurisdiction, subject to applicable consumer rights.

18. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy are the entire agreement regarding NurseExhale. Our failure to enforce a provision is not a waiver.
